GREEN RIVER HONEY WHISKEY PROMOTIONAL EXPERIENCE

OFFICIAL TERMS & CONDITIONS

VOID WHERE PROHIBITED BY LAW.  THIS PROMOTION INVOLVES THE PURCHASE AND DELIVERY OF ALCOHOLIC BEVERAGES AND IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS.  PARTICIPATION IS LIMITED TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE TWENTY-ONE (21) YEARS OF AGE OR OLDER.  PLEASE DRINK RESPONSIBLY.

 

1. NO PURCHASE NECESSARY

No purchase is necessary to enter or win this promotion.  A purchase will not increase the odds of selection.  Void where prohibited.

2. SPONSOR

This promotion is sponsored by Green River Distilling Company, LLC, a Kentucky limited liability company (“Sponsor”), with its principal place of business located at 10 Distillery Road, Owensboro, Kentucky 42301.  All questions, comments, or complaints regarding this promotion should be directed to Sponsor at the address above or at contact@greenriverspirits.com.

This promotion is skill-based and is administered in accordance with the laws of the Commonwealth of Kentucky.  Sponsor is a licensed manufacturer of distilled spirits under applicable federal and Kentucky law.

3. ELIGIBILITY

This promotion is open only to natural persons who, at the time of entry, satisfy ALL of the following requirements:

• Are legal residents of the United States;
• Are twenty-one (21) years of age or older;
• Have a valid, government-issued photo identification establishing age and identity; and
• Are not otherwise ineligible under these Terms.

 

The following individuals are NOT eligible to participate:

• Employees, officers, directors, members, and managers of Sponsor or any of its parent companies, subsidiaries, affiliates, advertising agencies, promotion agencies, or third-party administrators involved in this promotion; and any employees, agents, or representatives of federal, state, or local alcohol regulatory or enforcement agencies, as well as any licensed alcohol manufacturers, suppliers, importers, distributors, wholesalers, or retailers.
• Immediate family members (defined as spouse, parent, child, sibling, and grandparent, whether by birth, adoption, or step-relation) and household members of any of the foregoing, regardless of where they reside; and
• Any person who is prohibited by Applicable Law from participating in this promotion or purchasing alcoholic beverages.

 

Nominee Eligibility:  Any individual nominated by an entrant must independently satisfy the eligibility requirements set forth above, including the twenty-one (21) years of age requirement.  By submitting a nomination, the entrant represents and warrants that, to the best of the entrant’s knowledge, the nominee satisfies all eligibility requirements and has consented to being nominated.  Sponsor reserves the right to verify eligibility at any time.

4. PROMOTION PERIOD

Entry Period:  Entries will be accepted beginning at 12:00:01 a.m. Eastern Time (ET) on 5/12/2026 and ending at 11:59:59 p.m. ET on 12/31/26 (the “Promotion Period”).  Sponsor’s computer or promotion administrator’s clock is the official timekeeping device for this promotion.  Entries received before the start or after the close of the Promotion Period will be void.

Selection Period:  Winner/s selection will be conducted on or about 7/1/2026.  Sponsor reserves the right to extend or shorten the Promotion Period for any reason, including legal or logistical necessity, by posting notice at https://greenriverwhiskey.com/honey-whiskey.

5. HOW TO ENTER

To enter, eligible participants must submit ALL of the following during the Promotion Period via https://greenriverwhiskey.com/honey-whiskey.

Entrant’s full legal name;

• Entrant’s valid mailing address, email address, and telephone number;
• Entrant’s date of birth (for age verification purposes);
• Full name and city/state of residence of the nominated individual (the “Nominee”);
• A written submission of no more than 1000 words describing why the Nominee should receive the promotional experience and why the Nominee would make a positive and engaging representative of the Green River Honey DeliverBEE submission. Sponsor’s brand (the “Submission”); and
• An affirmative representation that all information provided is truthful and accurate.

 

Limit ONE (1) entry per person.  Multiple entries from the same person, household, email address, or IP address will be void.  Entries generated by script, macro, bot, or other automated means are prohibited and will be disqualified.  Sponsor is not responsible for lost, late, misdirected, incomplete, or illegible entries.

 

Nominee Consent:  By submitting a nomination, the entrant represents and warrants that:  (a) the entrant has obtained the Nominee’s prior consent to submit the Nominee’s name and information; (b) the Nominee is aware of and consents to these Terms; and (c) the Nominee is an eligible person as defined in Section 3.  Sponsor assumes no liability for entries submitted without proper Nominee consent.

6. CONTEST SELECTION & JUDGING

Skill-Based Contest:  This is a SKILL-BASED CONTEST, NOT A SWEEPSTAKES OR LOTTERY.  Winners are selected based on the merit of their Submissions as evaluated against the judging criteria below.  Chance plays no role in the selection of winners.

 

Submissions will be evaluated by a panel of qualified judges designated by Sponsor (the “Judging Panel”) on the following equally-weighted criteria:

Sponsor reserves the right to select between three (3) and five (5) winners (and a corresponding number of alternates), at Sponsor’s sole discretion, based on the quality of Submissions received.  Sponsor may elect to select fewer winners if an insufficient number of qualifying Submissions are received.  In the event of a tie, the tied Submissions will be re-evaluated on the criterion of “Engagement Potential.”  All decisions of the Judging Panel are final and binding and are not subject to appeal or review.

7. WINNER NOTIFICATION & VERIFICATION

Potential winners will be notified by Sponsor via the email address provided at entry within approximately 10 business days following the conclusion of the judging period.  If a potential winner does not respond to Sponsor’s notification within seventy-two (72) hours of the initial notification attempt, or if the notification is returned as undeliverable, Sponsor reserves the right to disqualify that potential winner and select an alternate winner from the pool of alternates in accordance with the judging criteria.

 

Prior to being declared an official winner, each potential winner (and, where applicable, the Nominee) must:

• Complete and return an Affidavit of Eligibility and Liability/Publicity Release (the “Affidavit”) within 10 days of receipt;
• Provide government-issued photo identification establishing that the winner and Nominee are each twenty-one (21) years of age or older;
• Provide proof of U.S. residency; and
• Satisfy any additional verification requirements imposed by Sponsor or required by Applicable Law.

 

Failure to timely return the Affidavit, failure to satisfy eligibility requirements upon verification, or return of any notification as undeliverable will result in disqualification and selection of an alternate winner.  Sponsor is not responsible for any winner’s failure to receive notification due to spam filters or other technical issues.

8. PRIZE DESCRIPTION

Each verified winner shall be entitled to receive the following prize (the “Prize”):

 

Prize Component 1 — Product Purchase Opportunity:  The opportunity to purchase one (1) standard-sized bottle of Green River Honey Whiskey (the “Product”) at the Manufacturer’s Suggested Retail Price (“MSRP”) as of the date of purchase, subject to product availability and all Applicable Laws governing the sale, distribution, and delivery of distilled spirits.  THE PURCHASE IS A SEPARATE TRANSACTION FROM THIS PROMOTION.  NO ALCOHOL IS PROVIDED AS A FREE PRIZE.  WINNER MUST SEPARATELY AGREE TO PURCHASE TERMS AT THE TIME OF PURCHASE.

 

Prize Component 2 — Promotional Delivery Experience (Optional):  If the winner elects to participate, the winner may receive a promotional delivery experience arranged by Sponsor or its designated third-party administrator (the “Experience”).  The Experience may include a live performance, brand activation, or other promotional element conducted at the time of product pickup or delivery.  The Experience has no cash value, is non-transferable, and may not be substituted, except at Sponsor’s sole discretion.

 

IMPORTANT PRIZE NOTICES:

• The Prize does not include any alcohol provided free of charge. The product purchase opportunity requires a separate, voluntary purchase transaction by the winner.
• The Experience is entirely optional. A winner’s election not to participate in the Experience does not affect the winner’s purchase opportunity.
• The approximate retail value (“ARV”) of the Experience component is $0., as it is an optional promotional activity with no independent retail value. Sponsor makes no representation regarding the ARV of the Product purchase opportunity, as that is determined by the MSRP at the time of purchase.
• Winners are responsible for all applicable federal, state, and local income taxes on any Prize received. Sponsor may require completion of IRS Form W-9 or equivalent documentation prior to Prize fulfillment if the ARV of the Prize exceeds applicable IRS reporting thresholds.
• The Prize is non-transferable. No cash equivalent will be awarded.
• Sponsor reserves the right to substitute a Prize of equal or greater value in its sole discretion.

9. ALCOHOL SALES, DELIVERY & FULFILLMENT

IMPORTANT — ALCOHOL REGULATORY COMPLIANCE:  All product sales and deliveries are subject to the laws of the Commonwealth of Kentucky and applicable federal law governing the manufacture, sale, and distribution of distilled spirits.  Sponsor is a licensed distillery operating under applicable state and federal permits.  All sales will be conducted through properly licensed channels only.

 

The following conditions apply to all product sales and fulfillment:

• Age Verification: Mandatory age verification (21+) will be conducted at the time of sale, pickup, and/or delivery by government-issued photo identification.  Failure to provide satisfactory proof of age will result in forfeiture of the purchase opportunity.
• Licensed Channels: All sales, transfers, and deliveries of the Product shall be conducted exclusively through channels properly licensed under applicable law.  Sponsor will not deliver alcohol in violation of state law.
• Geographic Limitations: Delivery availability is subject to the laws of the winner’s and Nominee’s state and locality of residence.  Where direct-to-consumer delivery is not permitted or practicable, Sponsor will offer an alternative fulfillment method, which may include in-person pickup at Sponsor’s licensed premises or fulfillment through a licensed retailer in the applicable jurisdiction.
• Kentucky Law: The fulfillment of this promotion is intended to comply with KRS Chapter 243 (Kentucky Alcoholic Beverage Control Law) and all regulations promulgated thereunder.  Nothing in these Terms shall be construed to require Sponsor to engage in any transaction prohibited by Applicable Law.
• Responsibility for Compliance: Sponsor reserves the right to modify, substitute, or decline fulfillment if, in Sponsor’s sole determination, fulfillment would violate any Applicable Law or would require Sponsor to obtain any additional license or permit not already held by Sponsor.

10. PROMOTIONAL EXPERIENCE DETAILS

For winners who elect to participate in the optional Experience:

• The Experience may include a live performance, branded activation, or similar promotional event conducted by Sponsor or a designated third-party agency at the time of product pickup or delivery.
• The format, timing, location, personnel, and specific elements of the Experience are subject to change at Sponsor’s sole discretion and without prior notice.
• Participation in the Experience requires the winner’s and Nominee’s affirmative consent and execution of a separate Experience Participation Agreement and Liability Waiver prior to commencement of the Experience.
• Sponsor reserves the right to cancel or modify the Experience at any time for legal, safety, logistical, or any other reason without liability.
• The Experience will be conducted in a manner consistent with applicable Kentucky Alcoholic Beverage Control laws and regulations and all applicable local ordinances.
• Winners and Nominees must be present and in possession of valid government-issued identification confirming age (21+) at the time of the Experience.

11. PUBLICITY; FILMING & RECORDING

The following provisions govern the use of winners’ identities, likenesses, and related content:

 

Filming and Recording Consent — Optional:  Participation in any filming, photography, audio recording, or other documentation of the Experience (collectively, “Recordings”) is entirely voluntary and is not a condition of entry, winning, or participation in the Experience.  No Recording of any winner or Nominee will occur without the prior written consent of such individual.

 

Separate Release Required:  Any winner or Nominee who consents to filming must execute a separate written Recording Release and License Agreement (“Release”) prior to any Recording activity.  The Release will set forth the specific permitted uses of the Recording and the scope of the license granted.  Execution of the Release is voluntary, and a winner’s election not to execute the Release will not affect the winner’s Prize eligibility.

 

Permitted Uses of Approved Content:  Subject to the terms of an executed Release, Sponsor and its licensees may use approved Recordings and related content (including name, voice, likeness, photograph, and written statements) for Sponsor’s marketing, advertising, public relations, social media, and promotional purposes, in all media now known or hereafter developed, throughout the world, in perpetuity, without further compensation to the winner or Nominee beyond the Prize.

 

Winner’s Name for Publicity:  Except where prohibited by law, by accepting a Prize, each winner consents to Sponsor’s use of the winner’s first name and state of residence for publicity purposes related to this promotion, without additional compensation.  Sponsor will not use a winner’s surname or complete address in any public disclosure.

12. SUBMISSION STANDARDS & DISQUALIFICATION

Each Submission must be the original, creative work of the entrant.  By submitting an entry, the entrant represents, warrants, and covenants that:

• The Submission is original and does not infringe any third-party intellectual property rights, including copyrights, trademarks, rights of publicity, or privacy rights;
• The Submission does not contain defamatory, disparaging, hateful, offensive, sexually explicit, or otherwise unlawful content;
• The Submission does not disparage Sponsor, Green River Distilling Company, or any affiliated brands or products;
• The entrant has the legal right and authority to submit the Submission and to grant Sponsor the rights described herein; and
• All information contained in the Submission is truthful and accurate.

 

Sponsor reserves the right, in its sole discretion, to disqualify any entry or entrant for any of the following reasons:  (a) failure to comply with these Terms; (b) submission of false or misleading information; (c) use of automated entry methods; (d) tampering with the entry process or operation of the promotion; (e) acting in a disruptive, unsportsmanlike, or annoying manner; or (f) any other conduct that Sponsor deems, in its sole discretion, to be inconsistent with the spirit or intent of this promotion or Sponsor’s brand values.  Sponsor’s determinations regarding disqualification are final and binding.

 

Sponsor reserves the right to modify, suspend, or cancel the promotion at any time for any reason, including technical difficulties, force majeure events, or legal or regulatory changes, without liability to any entrant.  In the event of cancellation, Sponsor may, at its discretion, select winners from Submissions received prior to cancellation.

13. INTELLECTUAL PROPERTY

License Grant by Entrant:  By submitting an entry, each entrant grants Sponsor a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, display, distribute, and create derivative works of the Submission for Sponsor’s internal evaluation purposes.  If the entrant is selected as a winner and executes a Release, the scope of the license will be as set forth therein.

 

Sponsor’s Intellectual Property:  All Sponsor trademarks, brand names, logos, and trade dress (including the Green River Distilling Company name and Whiskey Honey brand) are the exclusive property of Sponsor.  Nothing in these Terms grants any entrant any right to use Sponsor’s intellectual property, except as expressly authorized in writing by Sponsor.

14. PRIVACY & DATA USE

Personal information collected from entrants in connection with this promotion will be used by Sponsor for the purpose of administering this promotion, verifying eligibility, notifying potential winners, and fulfilling Prizes.  Sponsor may also use entrant information for its own marketing purposes in accordance with Sponsor’s Privacy Policy, available at https://greenriverwhiskey.com/honey-whiskey.  By entering, each entrant consents to such use.  Sponsor will not sell entrant personal information to unaffiliated third parties.  Sponsor’s use of personal information is subject to its Privacy Policy and applicable law, including the Kentucky Consumer Protection Act, KRS Chapter 367.

15. THIRD-PARTY ADMINISTRATOR

Sponsor may engage one or more third-party agencies or administrators to assist with the administration of this promotion, including entry collection, judging, winner notification, Experience coordination, and fulfillment logistics (each, a “Third-Party Administrator”).  Each Third-Party Administrator acts at the direction of and under contractual obligation to Sponsor.  Sponsor remains solely responsible for the overall administration of this promotion and compliance with these Terms.  References to “Sponsor” in these Terms shall include Third-Party Administrators acting within the scope of their authority, unless otherwise specified.

16. RELEASE; LIMITATION OF LIABILITY; INDEMNIFICATION

Release:  BY ENTERING THIS PROMOTION, EACH ENTRANT AND (WHERE APPLICABLE) EACH NOMINEE AGREES TO FULLY RELEASE, DISCHARGE, AND HOLD HARMLESS SPONSOR AND ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, AGENTS, THIRD-PARTY ADMINISTRATORS, ADVERTISING AGENCIES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING OUT OF OR RELATED TO:  (A) PARTICIPATION IN THIS PROMOTION OR THE EXPERIENCE; (B) ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE; (C) ANY TECHNICAL FAILURE OR MALFUNCTION AFFECTING THE PROMOTION; (D) ANY PRINTING OR TYPOGRAPHICAL ERROR IN THESE TERMS OR PROMOTIONAL MATERIALS; OR (E) ANY INJURY, LOSS, OR DAMAGE OF ANY KIND RESULTING FROM PARTICIPATION IN THIS PROMOTION.

 

Limitation of Liability:  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE RELEASED PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS PROMOTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  THE RELEASED PARTIES’ AGGREGATE LIABILITY TO ANY ENTRANT SHALL NOT EXCEED THE ARV OF THE PRIZE AWARDED TO SUCH ENTRANT.

 

Indemnification:  Each entrant agrees to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from the entrant’s:  (a) breach of these Terms; (b) violation of any Applicable Law; (c) infringement of any third-party intellectual property, privacy, or publicity rights in connection with the entrant’s Submission; or (d) false or misleading representations made in connection with this promotion.

 

Sponsor’s Specific Non-Liabilities:  Sponsor is not responsible for:  (a) lost, late, misdirected, incomplete, illegible, or non-delivered entries or notifications; (b) errors or omissions in entries or in promotional materials; (c) unavailability or interruption of the internet or any electronic network; (d) any injury or damage to any person’s computer or mobile device related to participation; (e) the acts or omissions of any Third-Party Administrator; or (f) delivery restrictions, delays, or failures resulting from Applicable Law or logistical constraints beyond Sponsor’s reasonable control.

17. DISPUTE RESOLUTION; GOVERNING LAW

Governing Law:  These Terms and all matters arising out of or relating to this promotion shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws principles.

 

Jurisdiction:  Any dispute not resolved by binding arbitration (see below) shall be subject to the exclusive jurisdiction of the state and federal courts located in Nelson County, Kentucky, and each entrant irrevocably consents to personal jurisdiction and venue in such courts.

 

Binding Arbitration; Class Action Waiver:  EXCEPT FOR ANY CLAIM SEEKING INJUNCTIVE OR OTHER EQUITABLE RELIEF, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS PROMOTION OR THESE TERMS SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) UNDER ITS CONSUMER ARBITRATION RULES THEN IN EFFECT.  THE ARBITRATION SHALL BE CONDUCTED IN NELSON COUNTY, KENTUCKY.  EACH PARTY WAIVES ANY RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

 

Time Limitation:  Any claim arising out of or related to this promotion must be filed within one (1) year of the date of the event giving rise to the claim, or such claim shall be forever barred.

18. GENERAL CONDITIONS

The following general provisions apply to this promotion:

• These Terms constitute the entire agreement between Sponsor and each entrant with respect to this promotion and supersede any prior agreements, representations, or warranties.
• If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Sponsor’s failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Sponsor reserves the right to amend or supplement these Terms at any time by posting updated Terms at https://greenriverwhiskey.com/honey-whiskey. Entrants are responsible for reviewing the Terms periodically.
• This promotion is subject to all applicable federal, state, and local laws and regulations, including, without limitation: (a) the Federal Trade Commission Act; (b) the Federal Alcohol Administration Act; (c) KRS Chapter 243 (Kentucky Alcoholic Beverage Control); (d) KRS Chapter 528 (Kentucky gambling laws, to the extent applicable); and (e) all applicable advertising laws and regulations.
• To request a list of prize winners or a copy of these Terms, send a self-addressed stamped envelope to: Green River Distilling Company, LLC, Attn: DeliverBee Winners List, 730 W Main St. Louisville, KY 40202.  Requests must be received by 12/31/2027.
• This promotion is intended for entertainment and brand-awareness purposes only and is not a lottery, sweepstakes, or game of chance under applicable Kentucky or federal law. In the event any regulatory authority determines that this promotion constitutes a lottery, sweepstakes, or other regulated game of chance, Sponsor reserves the right to immediately cancel the promotion.
